ARTICLE 1: SCOPE OF APPLICATION
These general terms and conditions of sale concern sales made by Alhuilesurtoile.com on its websites (alhuilesurtoile.com, www.alhuilesurtoile.com) and those of its partners.
ARTICLE 2: DELIVERY TIME
The seller undertakes to respect the average delivery time indicated on the website at the time of ordering, but it does not constitute a strict deadline, and Alhuilesurtoile.com cannot be held liable for the direct or indirect consequences of an order cancellation or delivery delay for any reason whatsoever, particularly in the event of disruption or strike by transport services and, generally, in the event of circumstances beyond its control or in the event of the absence of the person to whom delivery can be made at the address indicated at the time of the order.
Delivery times are calculated from the dispatch of the order. A confirmation e-mail is sent at the time of order dispatch.
ARTICLE 3: DELIVERY
It is expressly agreed that the transfer of risk for the ordered goods becomes effective upon their departure from our stores. The buyer consequently agrees to accept all risks thereof, particularly those related to transport (except in EXPRESS delivery mode).
It is the buyer’s responsibility to make, where applicable, the customary reservations before taking delivery. To safeguard their rights, it is imperative to write the following note on the delivery slip kept by the delivery person: "subject to unpacking, the delivery person cannot wait".
ARTICLE 4: TAXES
Most countries do not levy an import tax on hand-painted art reproductions. However, customers are invited to inquire in their country of residence if this is a concern. The customer is responsible for international import duties and/or taxes related to entry into the destination country.
ARTICLE 5: PAYMENT
Payment is made under the conditions provided at the time of ordering. Delivery costs are borne by the buyer and are paid by them at the time of the order. All purchases are payable in full at the time of ordering.
ARTICLE 6: CLAIMS
Upon delivery, the buyer is required to check the goods. Any reservations they intend to make regarding the condition of the delivered goods must be mentioned on the delivery slip. To safeguard their rights, it is imperative to write the following note on the delivery slip kept by the delivery person: "subject to unpacking, the delivery person cannot wait".
Failing notation on the delivery slip, no claim will be accepted after receipt of the goods, except in the case of a hidden defect.
ARTICLE 7: SATISFACTION GUARANTEE, EXCHANGE OR REFUND
All merchandise returns must be made in their original packaging. Should an item be defective or non-compliant, we undertake to exchange or refund it, provided that it is returned to us at the address communicated to you, in its original packaging without delivery against signature or acknowledgment of receipt, unused, and accompanied by the corresponding Alhuilesurtoile.com invoice within 30 days following receipt of the package. Return costs remain at your expense.
In the event of a refund, Alhuilesurtoile.com is obligated to refund the sums paid by the buyer in exercising their right of withdrawal, including transport costs (regarding outbound shipping). However, return costs will be borne by the customer. The refund will be made either via PayPal or bank transfer (depending on the buyer’s payment method) within a period less than or equal to 15 days following the date of receipt of the returned package. No cash on delivery (COD) shipments will be accepted, whatever the reason.
Please note: this guarantee does not apply:
• To unsealed products that are immediately reproducible.
• To specific products made on demand: studies, personalized products.
The defective item will be replaced as soon as possible.
ARTICLE 8: PRICE
We reserve the right to change our prices at any time, but we commit to applying the rates in effect that were indicated to you at the time of your order. The price is payable in full and in a single payment at the time of ordering.
All orders are invoiced and payable in Euros only.
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stock.
In the event of unavailability of non-stocked products after placing your order, we will notify you by e-mail upon receipt of the information transmitted by the suppliers. Unless you desire a replacement solution for an equivalent item, your unavailable order will be automatically cancelled and you will be refunded if your bank account has been debited.
ARTICLE 9: PAYMENT METHODS
The price is due immediately on the date of the order. Only payments by credit card (Carte Bleue, Visa, Eurocard/Mastercard), checks, and bank transfers are authorized.
Secure online payment by credit card is guaranteed by PayPal and presents full security. The transmitted information is encrypted by software and cannot be read during transport over the network (secure input via SSL encryption).
Payment by bank check is possible only for checks in Euros drawn on a bank domiciled in the Eurozone. The check must be made payable to "M. BOURGES", and sent without delivery against signature or acknowledgment of receipt to the address communicated to you following the registration of your order.
If you choose to pay by bank check, the order will only be processed upon its collection/cashing, and delivery times will run accordingly.
ARTICLE 10: LIABILITY
Alhuilesurtoile.com makes every effort to ensure the confidentiality and security of data that may be entered or transmitted through its services, but cannot, however, be held responsible for their deterioration, loss, or accidental "hacking" that might occur despite all precautions taken. The user of the service, whether subscribed or not, therefore releases Alhuilesurtoile.com from any legal action and any claim for damages resulting from the loss and/or hacking of data.
ARTICLE 11: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS
The transfer of ownership of the products to the buyer will only take place after full payment of the price by the latter, and this, regardless of the delivery date of said products. This retention of title does not prevent the transfer of risks, which will be borne by the buyer from the date the ordered products leave our premises in accordance with the provisions of Article 3.
ARTICLE 12: COPYRIGHT
According to the law, the work must date from at least 50 years ago and the artist painter must have been deceased for more than 50 years. All reproductions with dimensions equal to those of the original work are refused. No signature of the artist painter author of the original work will be reproduced on the canvas. Alhuilesurtoile.com will be obliged to cancel any order not respecting these conditions.
ARTICLE 13: RIGHT OF ACCESS AND RECTIFICATION
Alhuilesurtoile.com treats all information concerning you with the strictest confidentiality. During your purchases, we only ask for essential information (surname, first name, address, e-mail), and we prohibit any use of the data communicated on the www.Alhuilesurtoile.com site for any purpose other than for quality processing and careful monitoring of your order. In accordance with the "Informatique et Libertés" law, you have the right to access and rectify data concerning you.
ARTICLE 14: APPLICABLE LAW
All clauses appearing in these general terms and conditions of sale, as well as all purchase and sale operations covered herein, shall be subject to Vietnamese law. The courts shall be those within the jurisdiction of Ho Chi Minh City, Courts of the registered office of Alhuilesurtoile.com where the contract between the parties is formed when the co-contractor has the quality of a merchant. When the co-contractor does not have the quality of a merchant, the Court of the place of effective delivery of the order may also be seized.
ARTICLE 15: BUYER’S ACCEPTANCE
These general terms and conditions of sale, as well as the prices, are expressly agreed to and accepted by the Buyer, who declares and acknowledges having perfect knowledge thereof, and thereby waives the right to rely on any contradictory document and, notably, their own general terms and conditions of purchase, the act of purchasing implying acceptance of these general terms and conditions of sale.
These conditions are modifiable at any time without notice.
